What Australian law looks at, and what Refrendo records
Under the Electronic Transactions Acts, an electronic signature meets a legal requirement for a signature when the method identifies the person, shows they intended to sign, is reliable for the purpose, and the other party has agreed to deal electronically. Refrendo records evidence on each point. Whether a particular signature meets them is for the parties, and in a dispute, a court.
- Identity: each signer gets their own link at their own email address, with an access code from you as well if you ask for one, and colleagues sign from their signed-in account. The certificate records how each person was identified.
- Consent: before they see the document, each person agrees to use electronic records and signatures, after reading a short disclosure from the organisation that sent it. The certificate records when they agreed, and to which version of the disclosure.
- Intention: before completing, signers see explicit consent wording, which is stored as shown and in the language they saw it.
- Reliability: SHA-256 fingerprints of the original and final document, and an audit trail where every event is chained to the last.
Some documents still need wet ink or witnessing depending on the state, most obviously wills. When in doubt, check with your adviser.
